Disclosure

Important information about who we are, how we operate, and how your enquiry is handled.

Effective date: [DATE]

1. What We Are

Halal Mortgage Australia (ABN [PLACEHOLDER: Insert ABN]) is a referral and information service. We provide general information about Sharia-compliant finance products available in Australia and connect enquirers with licensed mortgage brokers who specialise in Islamic finance.

We are not a licensed credit provider, mortgage broker, or financial adviser. We do not hold an Australian Credit Licence (ACL) and do not provide credit assistance as defined under the National Consumer Credit Protection Act 2009 (NCCP Act).

2. What We Do

Our services are limited to:

  • Providing general information about Sharia-compliant finance options (home loans, refinancing, car finance, commercial loans, and superannuation)
  • Receiving enquiries from people interested in Sharia-compliant finance
  • Connecting enquirers with licensed mortgage brokers from our network who can assist them

We do not assess your financial situation, recommend specific products, process loan applications, or provide personal financial advice of any kind.

3. General Information Only

All content on this website is general in nature. It does not take into account your personal financial situation, objectives, or needs.

You should seek independent financial advice before making any decisions about home loans, refinancing, or any other financial product. A licensed mortgage broker or financial adviser can assess your individual circumstances and provide personalised guidance.

For independent consumer guidance, visit Moneysmart.gov.au, a resource provided by the Australian Securities and Investments Commission (ASIC).

4. How We Make Money

We may receive referral fees from licensed mortgage brokers or lenders when an enquiry we refer results in a completed transaction (such as a settled loan).

This means we have a financial interest in connecting you with brokers. However:

  • This arrangement does not affect the cost of services to you — you do not pay us any fees.
  • The referral fee we receive does not increase the cost of your loan or the fees charged by the broker or lender.
  • We aim to connect you with brokers who are suitable for your stated needs, but we cannot guarantee any particular outcome.

5. How Your Enquiry Is Handled

When you submit an enquiry through our website:

  1. We receive your details — Your name, phone number, email address, service interest, and any message you include are submitted to us via our contact form.
  2. Your details may be shared with licensed brokers — We may share your enquiry details with one or more licensed mortgage brokers from our network who specialise in the type of product you are interested in.
  3. A broker may contact you — A licensed broker may reach out to you to discuss your needs and provide personalised assistance.

The licensed mortgage brokers in our network hold their own ACL and are independently responsible for complying with the NCCP Act, including:

  • The Best Interests Duty — acting in your best interests when providing credit assistance
  • Providing you with a Credit Guide before assisting you
  • Conducting a responsible lending assessment of your financial situation
  • Meeting all ongoing regulatory obligations under their licence

6. No Guarantee

We do not guarantee:

  • That you will be approved for a loan or finance product
  • Specific interest rates, fees, or product terms
  • Product availability or suitability for your circumstances
  • That a broker will be able to assist you

All lending decisions are made by licensed lenders based on their own assessment criteria. The terms you are offered will depend on your individual financial circumstances.

7. Product Information

Rates, fees, and product features displayed on this website are indicative only. They are sourced from third-party providers and may change without notice.

Where comparison rates are shown, they are calculated based on specific loan amounts and terms as required by law. A comparison rate may not reflect the actual rate or total cost applicable to your loan. You should confirm all rates and terms directly with the broker or lender before proceeding.

WARNING: The comparison rate is true only for the examples given and may not include all fees and charges. Different terms, fees, or loan amounts may result in a different comparison rate.

8. Sharia Compliance

Information about Sharia compliance on this website is provided for general guidance only.

We are not a Sharia authority and do not certify the Sharia compliance of any product. Products described as "Sharia-compliant" or "halal" on this website have been reviewed by qualified Islamic finance scholars engaged by the relevant lenders or product providers.

If Sharia compliance is important to you, we encourage you to seek your own independent religious guidance and to verify the compliance of any product directly with the lender and their appointed Sharia advisory board before proceeding.

9. Your Rights

You have the right to:

  • Ask how your personal information will be used before submitting an enquiry
  • Request that your information not be shared with brokers
  • Access and correct the personal information we hold about you
  • Lodge a complaint if you are unhappy with how your information has been handled

For more information about your privacy rights, see our Privacy Policy.

10. Complaints

If you have a complaint about our service, please contact us using the details in Section 11 below. We will acknowledge your complaint within 7 days and aim to resolve it within 30 days.

Complaints about a licensed broker: If your complaint relates to the conduct of a licensed mortgage broker you were referred to, you should contact that broker directly in the first instance. Licensed brokers are required to have an internal complaints process and must be a member of an External Dispute Resolution (EDR) scheme.

If the broker does not resolve your complaint, you can escalate it to the Australian Financial Complaints Authority (AFCA):

  • Online: www.afca.org.au
  • Phone: 1800 931 678 (free call)
